Auction Terms
Selling on Behalf of Commissioner:
REPRESENTATION: United Country, Rogers Auctioneers, Inc. and its agents represent the Seller only. INDIVIDUAL PURCHASES Individual purchases are to be considered as a single transaction not contingent upon acceptance of any other bids by the Seller. Auctioneer has the right to sell this property in any form or fashion that is legal and ethical in order to produce the best offer for the Seller. Statements from the auction podium take precedence over all previous statements either written or oral.
CONDITIONS OF SALE It is the responsibility of the buyer to personally inspect the property being sold and to bid accordingly based on his/her judgment. Inspections which may constitute a condition of sale must be completed prior to auction. The successful bidder will be required to sign the purchase agreement of which a sample is in your bidder information packet. No modification other than adding tract(s) purchased and bid amounts is to be made. This is a cash transaction and is not subject to the Buyer obtaining financing or any other contingency. Buyer will receive a Commissioner’s Deed with possession being granted to the Buyer at closing. Deed will be subject only to: 1) zoning ordinances affecting said property: (2) general utility, sewer, road, and drainage easements of record; (3) subdivision easements, covenants and restrictions of record, if any; and (4) leases, other easements, other restrictions and encumbrances specified herein. *This property is sold subject to all outstanding easements on said property for roads, power and telephone lines and the like and likewise subject to any cemetery or cemeteries that may now exist on this property. *Auctioneer and Sellers do not warrant or covenant with Buyer with respect to the existence or nonexistence of any pollutants, contaminants or hazardous waste prohibited by federal, state, or local law or claims based thereon arising out of the actual or threatened discharge, release, disposal, seepage, migration or escape of such substances at, from or into the demised premises. Buyer is to rely upon their own environmental audit or examination of premises. *This sale excludes all personal property located on the real estate. Confirmation of the auction bid price will be made by County Clerk of Court. 10 Day upset bid period applies.
TERMS OF REAL ESTATE. Although there is no obligation to bid, all prospective buyers must register in order to bid at the auction with valid State Issued Identification. At the end of the auction, the Successful Bidder will submit a non-refundable earnest money deposit in the amount of 10% of the contract purchase price in the form of cash, cashier’s check, company or personal check with a bank letter of credit or guarantee. Balance due at closing 30 days after auction or after clerk of court has confirmed sales price. A 10 Percent (10%) Buyers Premium will be added to the highest bid price to determine the final contract purchase price of the property. Example: You bid $1,000. Your final contract purchase price will be $1,100. All checks will be written to Rogers Auctioneers, Inc., Escrow Account.
